What actually constitutes an enemy of the constitution today? What is part of the free democratic basic order (FDGO) and what is not. The importance of conceptual clarity is significant and difficult.



The concept of an enemy of the constitution is shaped by case law and is never clearly defined. This is not an omission, but a deliberate one. The view of what constitutes a threat to the rule of law has also changed.


There are several current examples of anti-constitutional aspirations. The influence of anti-constitutional tendencies within the AfD is growing, according to the Federal Office for the Protection of the Constitution (BfV). A higher administrative court also saw anti-constitutional tendencies in the behavior of a police trainee who had repeatedly liked posts from the New Right on social media. By approving the posts trivializing National Socialism, he had violated his duty of loyalty to the constitution.


State observation targets are increasingly Reichsbürger, left-wing extremism, the New Right and Islamist terrorism. But is a citizen who is not loyal to the constitution automatically anti-constitutional? Where are the red lines today? Important questions to which we are looking for answers with experts.
